Terms & conditions

Last updated 29 July 2026

These terms explain how table requests work and the rules that apply when you use our website or visit the restaurant.

On this pageAbout usBookingsChanges and cancellationsMenus and allergensYour visitWebsite useResponsibilityContact and law

1. About us and these terms

These terms apply to table requests made through this website and to use of the website. Restaurant services are provided by Seafood at Dawn Limited, a company registered in England and Wales under number 15250658.

Trading address
Seafood at Dawn, Coast Road, West Mersea, Colchester, Essex CO5 8LS

2. Table requests and confirmation

  • An online submission is a request, not a confirmed reservation.
  • Your booking is confirmed only when our team sends confirmation by email or otherwise tells you it is confirmed.
  • You must provide accurate contact and party details so we can review and manage the request.
  • Online booking is currently available for parties of up to seven. Please contact us directly for larger groups.
  • Seating areas and specific tables are requests. We will try to honour them but cannot guarantee a particular table.

If we cannot accept a request, for example because the table is no longer available, no contract for that booking is formed. The booking service does not currently take payment.

3. Changes, lateness and cancellations

To change or cancel a booking, call or email us as soon as possible and quote the booking reference. If you are running late, please let us know. If a party is materially late and we cannot reach you, we may release the table where reasonably necessary to serve other guests.

We may need to change or cancel a booking because of severe weather, safety concerns, supplier failure, staff illness, closure or another event outside our reasonable control. We will give as much notice as reasonably possible and offer a practical alternative where we can.

No deposit or cancellation fee applies to the current online request service. If a future event or group booking requires a deposit, we will explain the amount, cancellation deadline and refund terms clearly before you agree or pay.

4. Menus, prices and allergens

Seafood is seasonal, so dishes, ingredients, availability and prices may change. Website menus are a guide; the menu and price shown at the restaurant when you order will apply. Prices are in pounds sterling and include VAT where applicable.

Allergies and dietary needs

Tell us about allergies or intolerances when booking and speak to a member of staff again before ordering. Ingredients and preparation areas may involve cross-contact. Our team will explain current allergen information and whether we can safely accommodate your needs.

Please do not rely only on website descriptions or an earlier visit, as recipes and suppliers can change.

5. At the restaurant

Please behave considerately toward staff, other guests, neighbours and property. We may refuse service or ask someone to leave where reasonably necessary for safety, unlawful behaviour, serious disruption, harassment or abuse.

Children must be supervised. If you have an access requirement, contact us before visiting so we can explain the current facilities and make reasonable arrangements where possible. Outdoor seating depends on safe and suitable weather.

6. Website use and content

You may use this website for personal, lawful purposes. Do not try to disrupt it, bypass security, submit false bookings, introduce malicious code, scrape it excessively or use its content in a way that infringes another person’s rights.

Website text, branding, photographs and design are owned by us or used with permission and are protected by intellectual property law. You may not reproduce them commercially without written permission.

Links and embedded services provided by third parties, including maps and social media, are supplied for convenience. Their own terms and privacy notices apply when you use them.

7. Our responsibility

We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable, or for business losses where you use the service mainly for commercial purposes.

Nothing in these terms excludes or limits liability where the law does not allow it, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing affects your statutory consumer rights.

8. Personal information

Our privacy policy explains how we use booking and website information, including optional allergy or accessibility notes.

9. Complaints, governing law and contact

If something is wrong, please contact us promptly using the details above so we can try to resolve it. These terms are governed by the law of England and Wales. If you are a consumer, you may bring proceedings in the courts of the part of the UK where you live, as well as in England and Wales.

If a court finds part of these terms unlawful, the remaining terms will continue to apply. A delay in enforcing a right does not mean that right is waived. We may update these terms for future bookings, but the version in force when your booking was confirmed will apply to that booking.

External media: Google Maps

Google may process this information outside the UK using its own international-transfer arrangements.

We do not use personal information for solely automated decisions that produce legal or similarly significant effects.

Depending on the circumstances, you may ask us for access to your information, correction, deletion, restriction, portability, or to object to how we use it. Where we rely on consent, you can withdraw it at any time without affecting earlier lawful use.

Your right to object

You have the right to object to processing based on our legitimate interests. Tell us what you object to and why. We will stop unless we can show compelling legitimate grounds or need the information for legal claims.

Email [email protected] or write to our trading address. We may need to confirm your identity. There is normally no charge.
